Subject: School directors - Appointment and change of job - AS
2010 / 2011

Following the signing of Hypothesis Negotiable - Area V - school leadership on 19.5.2010, the discipline of the criteria for the award of the tasks and changes to school officials is no longer the case as falling between the subject of bargaining collective national integration and regional integration, as envisaged in the Previous Negotiable - Area V - 11 .4.2006 school leadership.
Currently, this matter is subject to the general discipline of art. 19 of Legislative Decree No 165 of 2001 as amended by art. 3 of Law No. 145 of 2002 and the provisions contained in Articles. 6:09 CCNL Hypothesis - Area V - 19.05.2010 at the school management was awaiting final signature.

Appointment of
Article 19 - Legislative Decree No 165/2001:
" 1. For the contribution of each position of executive function is taken into account in relation to the nature and characteristics of goals, attitudes and skills the individual professional manager, also assessed in the light of results achieved with reference to annual targets under Directive and in other acts of the minister .........";

Article 6 - CCNL/2010:
"3. Except as provided by art. 5. The criteria referred to in paragraph 3 can be integrated within the bargaining at the regional level with others related to specific local situations. "

So for the allocation of the tasks the SS.LL. take into account the criteria set out in Article. 6 of the said CCNL that relate to the size (number of students, number of faculty and staff ATA), the complexity (number of academic degrees, addresses) and the local context (particular areas of social disadvantage or local) educational institutions.

The SS.LL. may, where appropriate, incorporate these criteria adapted to local needs after bargaining with the unions at the regional level . Change of office


Article 9 - CCNL/2010:
" 1. The change of positions of managers shall take effect from the beginning of each school year or academic year.
2. The change of office on request the manager, in any case follow the below criteria:
a) experience and skills gained, can be derived also from the procedures of Article. 20 of the Negotiable 11-4-2006, the executive who got the change of office under this criterion is not entitled to make any further requests for the duration of the engagement;

4. The change of positions, which will take effect from the start of the school year, will be attribuito tenendo conto delle esperienze e delle competenze maturate da ciascun dirigente scolastico, desumendole anche dall’applicazione delle procedure di cui all’art. 20 del C.C.N.L. dell’11.4.2006, nonché dei criteri previsti dall’art. 9 del C.C.N.L. del 19.5.2010.
Considerata l’abolizione dei settori formativi e della conseguente mobilità professionale, giova richiamare l’attenzione sull’opportunità di procedere a mutamenti di incarico, in costanza di contratto, esclusivamente nei casi di particolare urgenza e di esigenze familiari richiamati al comma 3 del succitato art. 9, ovvero di ulteriori circostanze adeguatamente motivate dal competente Direttore Generale.
